The more recent cases that you have referred to, to do with mostly Welsh devolution, have been cases where there was a question of where to demarcate the powers of the devolved budget on the one hand and the powers reserved to Whitehall or Westminster on the other hand, and in that situation you cannot really take a generous view on one side of the equation without taking a narrow view on the other.
